This is an application for a grading permit exemption for agriculture. It does not exempt you from other federal, state or local regulations that may affect the proposed activity. Proposed activities within a wetland or shoreline (or their buffers) require review/approval by the Department of Natural Resources, Army Corps of Engineers, Maryland Department of the Environment, and the county. A copy of all permits or letter(s) of Exemption must accompany this application.

The Calvert County Erosion and Sediment Control Ordinance, Section 3.2.a, allows for an agricultural exemption from a grading permit if the site is currently zoned agricultural, AND one of the following conditions applies:

1. The activity involves an agricultural land management practice(s) required as part of your normal operation. This includes the installation of Best Management Practices (BMPs) as specified within a conservation plan approved by the Calvert Soil Conservation District, and normal tillage operations.

2. The activity involves the construction of agricultural structures. This includes barns, other agricultural related buildings or the replacement of the primary residence.

The following activities are NOT covered by this exemption:
a. Land disturbing activities within 100 feet of open water or a wetland.
b. Tillage operations within 25 feet of open water or wetlands.
c. Any change in land use where the activity exceeds 5,000 square feet (except where covered by an approved Soil
Conservation District conservation plan).
d. Construction of any building or single family residence other than item 2 above.
e. Excavation or mining of material more than one acre.
